O parlamento da União Europeia adoptou formalmente um novo conjunto de regras para asilo. As regras, vinculativas, incluem agora a identidade de género como motivo de perseguição que os estados membros devem ter em conta. Os governos já aceitaram a decisão, que é definitiva.

Action Request From Pembe Hayat
On 19th June 2010, 3 well-known trans human rights defenders from Pembe Hayat were subjected to arbitrary arrest and violence by the police officers of esat Police Station in Ankara. Buse Kılıçkaya, Selay Tunç and Naz Gudumen objected to the arbitrary arrest of the police officers, stating that the police officers misused the Police Authority and Duty Law and the Law on Misdemeanors just because of their gender identities. The only explanation from the police officers was, “Your crime is to be a transvestite.”

The 3 human rights defenders were taken to a police station by force and they were beaten up by the police officers. The victims filed complaints against the police officers however the relevant prosecutor’s office rejected the complaints on the basis that there was no clear evidence of violence. The police officers also complained against the human rights defenders with the allegation that they “resisted” and “insulted” the police and “destroyed the public good.”

The prosecutor’s office accepted the allegations of the police officers and opened a case against the human rights defenders in July 2010. The first hearing was held in october 2010 and the last hearing was realized in October 2011, when the human rights defenders were sentenced to prison sentences starting from 5 to 18 months. Buse Kılıçkaya, the board chair of Pembe Hayat, was sentenced to 5 months of prison sentence while Selay Tunc, the vice-chair of Pembe Hayat, was sentenced to 6 months of prison sentence. Naz Gudumen, an active member of Pembe Hayat, was sentenced to 18 months of prison sentence.

We kindly request our friends in other countries to support the 3 trans human rights defenders; and the trans community in Turkey. You can follow the instructions below:

1. You can send a letter to the relevant Turkish authorites in Turkey and/or to the Turkish mission in your countries, asking for an intervention to drop the charges against 3 human rights defenders. We suggest you to send the letters to the authorities both in Turkey and abroad.

2. You can organize a demonstration in front of the Turkish embassies/consulates in your countries, visibilising the issue and asking the Turkish authorities to take necessasy actions to stop harrasing trans persons in Turkey. You can request rendez vous from the Turkish Ambassadors, Consuls, etc. in your countries. You can encourage/ask supporting political figures [parliamentarians, artists, media people] to meet the Turkish authorities or visibilise the issue in the media.

3. You can visibilise the issue in the media in your countries, by giving interviews or by directing them to Pembe Hayat for interviews. Please do not hesitate to direct requests of interviews to me directly.

4. You can send letters to the relevant authorities in your countries [Ministry of Foreign Affairs, Joint Parliamentarian Working Groups, etc.] to ask them for raising the issue with the Turkish Government or parliamentarians; putting pressure over the Turkish Government by your Governments.

5. You can produce very short videos [30 seconds, etc.], stating that you support the trans human rights defenders and that the Turkish Government should take legal and de facto measures to stop harrassment of trans by the police. Also, you can criticize the impunity of the police officers. To ask the Turkish authorities to drop the charges would be another option. You can send these videos to me, while uploading/circulating the videos on Internet àYoutube, Twitter, Facebook, Vimeo, etc.
