Johnson urging the Richmond-based U.S. Court of Appeals for the Fourth Circuit to find that the Virginia Department of Correction’s housing policy for transgender inmates violates the Equal Protection, Due Process and Cruel and Unusual Punishment clauses of the U.S. Constitution.

In recent years, legal scholars and others have speculated as to whether a transgender individual had the right to sue for discrimination based on “sex.” Recently, the U.S. Court of Appeals for the 11th Circuit joined both the 9th and 6th Circuits in answering that question in the affirmative. Although the court’s decision was rooted in the Equal Protection Clause of the Fourteenth Amendment, the case is still instructive to private employers as the same analysis applied by the court can be applied to claims under Title VII.
