Federal Court Rules Against Wisconsin in Transsexual Prisoner Cases
Chief U.S. District Judge Charles N. Clevert, Jr., issued two lengthy opinions this month rejecting the state of Wisconsin's stance on medical treatment for transsexual prison inmates. In one case, Fields v. Smith, 2010 Westlaw 1929819 (E.D.Wis., May 13, 2010), Judge Clevert provided the detailed discussion promised earlier in a short order he had issued finding that the state had violated the 8th and 14th Amendment rights of transsexual prisoners by legislating that such prisoners could not be provided with hormones as a treatment for their gender identity disorder. In the other, Konitzer v. Frank, 2010 Westlaw 1904776 (E.D.Wis., May 10, 2010), the judge rejected the state's motion for summary judgment as to all but one of the claims asserted by a transsexual inmate concerning the refusal of prison authorities to allow the inmate to live as a woman, the lone exception being the judge's determination that the inmate's constitutional rights would not be violated by the prison adhering to a requirement that the inmate only be subjected to strip and pat-down searches by male corrections officers.

Mudar de nome no BI sem mudar de sexo
Em Portugal deverá ser possível um homem tornar-se mulher mantendo o pénis. BE avança com legislação. PS concorda.

Depois da despenalização do aborto, da legalização do casamento gay, do reforço das uniões de facto, há um novo tema fracturante na agenda parlamentar: o reforço dos direitos de identidade dos transexuais.

O Bloco de Esquerda apresenta na próxima semana um projecto que prevê que quem mudar de sexo, mesmo sem ter feito uma operação, terá direito a ver a mudança consagrada oficialmente nos documentos de identificação. Hoje, é impossível fazê-lo: um homem português que se torne mulher continua identificado no BI como tendo um sexo masculino (ou vice-versa).

Depois do BE será a vez do PS a seguir na mesma direcção. Entre os socialistas, a matéria está a ser preparada por Miguel Vale de Almeida, activista de longa data nas causas LGBT (Lésbicas, Gays, Bissexuais e Transgénero).

A discussão no plenário só deve acontecer na próxima sessão legislativa, ou seja, depois das férias do Verão. Até ao final da actual sessão a agenda já está completamente tomada.

Ambos os projectos prometem polémica. E isto por causa da forma como se reconhecerá que alguém mudou de sexo. Não será exigida nenhuma cirurgia: um homem poderá passar a ser oficialmente mulher mantendo o pénis; uma mulher poderá passar a ser reconhecida oficialmente como homem mantendo a vagina.

O reconhecimento - seguindo, aliás, legislação europeia - será feito socialmente. Um médico e/ou um psicólogo que acompanhem o transexual vão ter de atestar legalmente que a vida social do requerente já não está conforme o seu sexo "oficial". Ou seja, revelando, por exemplo, que faz tratamentos hormonais. E então a mudança será reconhecida nos documentos de identidade .

Perante a conjugação de vontades entre o BE e o PS - embora os socialistas preferissem que a matéria não fosse colocada já na agenda política -, o mais natural é que uma lei seja aprovada. Mas a margem não é folgada, até porque se desconhece a posição do PCP, que, ao que tudo indica, não se deverá opor.

No PS o assunto foi matéria de compromisso eleitoral e, sendo assim, implica disciplina de voto (excepto para as duas deputadas independentes de filiação ideológica democrata-cristã, Teresa Venda e Maria do Rosário Carneiro). Assim, os 95 votos socialistas somados aos 16 do BE e ainda aos dois de Os Verdes (que nunca se oporá) somarão 113; em sentido contrário presume-se o CDS (21 deputados), o PSD (81), as duas deputadas independentes do PS acima referidas, somando isto dá 104 votos contra (e pode ser que no PSD nem toda a gente vote no mesmo sentido, como aconteceu com o casamento gay).

Se o PCP (13 eleitos) se abstiver, a lei passa. Na verdade, só não passará se os comunistas alinharem com o CDS e o PSD, o que fontes internas consideram altamente improvável, mesmo reconhecendo que o partido resiste com dificuldade a legislação demasiado avant-garde. Tudo aponta para que na próxima sessão legislativa - até pode ser ainda este ano - o reforço dos direitos dos transexuais seja consagrado na lei.

Não se trata de nenhum artigo de opinião, mas um artigo informativo.
No entanto, a sua inexactidão é por demais gritante. O artigo refere que, e cito:" um homem português que se torne mulher continua identificado no BI como tendo um sexo masculino (ou vice-versa)". É falso, pois, em primeiro lugar o BI (que se encontra presentemente a ser substituído pelo CC (Cartão do Cidadão) não contém menção relativa ao sexo da pessoa (embora o CC já o mencione). Em segundo lugar, qualquer pessoa transexual hoje em dia pode mudar o género em toda a sua documentação desde que tenha feito a CRS (Cirurgia de Redesignação de Sexo), interpondo um processo contra o Estado Português nos tribunais.

O cerne da transexualidade encontra-se na IG (Identidade de Género) de cada pessoa. No entanto, na totalidade do artigo não existe uma única linha sobre a IG, que é precisamente a causa principal da transexualidade.

A maneira como o texto está escrito revela uma de duas coisas, ou ambas: ou quem o escreveu não se encontra informado sobre as questões de género, assim reduzindo-as a "pénis" e vaginas", ou reflecte o preconceito e animosidade do autor para com as pessoas transexuais.

O que se aceita num artigo de opinião, pois qualquer pessoa tem o direito de expressar a sua opinião, é completamente inaceitável num artigo informativo, como este.

O modo como se escreveu este artigo sobre esta problemática, além de revelar desconhecimento e inexactidão do que afirma, encontra-se feita de uma maneira que parece propositada para inflamar ânimos e incentivar ódios contra uma minoria já sobrecarregada de discriminação e intolerância, além de visar associar temas polémicos unicamente com a esquerda. Não é minimamente aceitável num artigo que visa informar um facto.

Este assunto não é de esquerda nem de direita, pois trata de assegurar direitos inerentes a qualquer pessoa e que têm sido negados sistematicamente a este reduzido grupo de pessoas.

Não informa que uma LIG retirará dos tribunais processos que nunca lá deviam ter ido parar, permitindo assim que a justiça economize tempo e dinheiro, podendo assim dedicar-se a outros processos legais.

Não informa que, com esta lei, o SNS poupará tempo, dinheiro e recursos, pois a maioria destas pessoas não mais serão forçadas a submeterem-se a cirurgias demasiado intrusivas e de convalescença custosa e demorada.

Não informa que esta lei permitirá que estas pessoas acedam ao mercado de trabalho mais facilmente, suavizando mas não acabando obviamente com as discriminações laboral e social existentes.

Ou seja, reduz tudo a uma mera questão de "pénis" e "vaginas".

Se tais factos podem-se aceitar em artigos de opinião ou comentários, o mesmo não se pode aceitar em artigos dirigidos à informação pública.

Assim, repudia-se totalmente o modo falacioso e preconceituoso em como este artigo se encontra escrito, e espera-se que a Alta Autoridade para a Comunicação Social e o Sindicato dos Jornalistas se pronunciem contra artigos deste tipo, que mais não fazem do que desinformar e incentivar a intolerância numa sociedade que se quer mais tolerante e mais justa para todos.

PARTE I

Este Sábado saiu uma reportagem sobre transexualidade no Diário de Notícias intitulada “O meu nome não é o meu sexo”. Como uma das pessoas que contribuiu para o artigo, vou tecer algumas considerações sobre o mesmo.

Em primeiro lugar, repudio totalmente o “Envergonhados” com que termina o lead da notícia. Expuseram uma maneira de sentir de uma parte da população T, sem explicarem que existem pessoas transexuais que não têm vergonha de o serem.

Da leitura do artigo retira-se a ilacção de que a comunidade transexual tem vergonha da sua transexualidade, como se o facto de se ser transexual seja motivo de vergonha e de repúdio. Nada mais falso.

Existem de facto transexuais que o sentem, sendo que as razões deste procedimento saberão eles quais são. Mas dar-se a ideia de que a comunidade toda é assim é ofensivo para quem aceita plenamente a sua transexualidade e não a renega.

Minoria silenciosa estamos, finalmente, a deixar de o ser, para sermos uma minoria que luta pelos seus direitos. E já não é de agora.

No meio das confusões, com tanta gente a dar o testemunho, acontecem erros, como o facto de ter iniciado o processo há dez anos, quando na realidade foi há mais ou menos cinco anos.

Podia ter sido muito mais inspirada, considerando, pelo menos, o que eu falei na entrevista, mas ficou-se mais pela banalidade dos coitadinhos. A abordagem quanto a mim, pecou nisto. Focou-se no comum, no mesmo que as outras entrevistas anteriores, em vez de aflorar aspectos talvez mais complicados mas de certeza menos banais. Compreenda-se, já saíram “n” entrevistas com pessoas transexuais a descreverem os problemas vivenciados e discriminações sofridas. Nada de novidades por este lado.

PARTE II

Mas existe algo que pode trazer uma discussão que, pelos vistos, ainda se torna necessária.

Refiro-me concretamente ao parágrafo “Vai contracorrente às pessoas e médicos do Santa Maria. "Um transexual que é transexual quer mudar o sexo!" É uma afirmação que se repete ao longo da reportagem.”

Ora bem, analizemos o parágrafo. Primeiro a frase “Um transexual que é transexual quer mudar o sexo”. Bem, esta afirmação é um completo anacronismo. O que define uma pessoa transexual? O ter nascido com genitália de um sexo e a sua Identidade de Género do sexo oposto. Identidade de Género (IG) refere-se a como cada pessoa se sente dentro do binómio masculino-feminino. Ou seja é a percepção que cada pessoa tem de si própria como pertencendo a um dos géneros.

Isto já foi dito e redito inúmeras vezes. Porque continua então a discriminação de uma minoria contra as restantes? Bem, a questão tem muito a ver com a psiquiatrização da transexualidade e com a auto-estima das pessoas transexuais.

Existe uma maioria de psiquiatras e psicólogos que vêem esta problemática do ponto de vista da genitália, desprezando a Identidade de Género. Homens têm pénis, mulheres têm vagina e pronto. A IG não é para aqui chamada. Ora como as pessoas nascem com um sexo ou outro, devem ter a sua IG concordante. As que não têm são etiquetadas imediatamente como doentes.

E então, como o corpo é que deve ter razão, e sem tomarem em conta que existe a possibilidade de o que está mal é o corpo, etiquetam logo essas pessoas como tendo um transtorno de Identidade de género, portanto se são doentes, e se a IG é mental, estas pessoas têm de ser doentes mentais.

E mesmo depois de anos de terapias falhadas para mudarem as IGs consideradas doentes, decidiram que o melhor seria fazerem-se as cirurgias e assim ficava tudo bem. Uma medida acertada tomada pelas razões erradas, na minha opinião.

Porque eu não vejo as coisas assim. Penso que o que define o género a que pertence uma pessoa é a sua IG e não o sexo com que se nasce. E porquê? Porque as terapias, aceites por muitos psiquiatras extremamente preconceituoso como o famoso e mal-amado Kenneth Zucker, adepto fervoroso destas terapias, têm sistematicamente resultado em rotundos fracassos.

Isto devia pelo menos avisar de que havia algum problema em relação à definição de género indicada pelo sexo de nascença.

Para mim indica claramente que o nosso género é aquele que a IG de cada pessoa indica, e não o que o sexo indica. Também me parece que, a ser assim, existe a possibilidade de nada estar errado com a IG da pessoa mas sim ser o corpo que está mal. Ou seja, o defeito está no corpo e não na mente.

Por isso sou totalmente contra a transexualidade ser considerada como doença mental. Concordo muito mais com a classificação de condição. Somos mulheres e homens que nasceram com a condição da transexualidade. Mas de modo algum me parece que sejamos doentes mentais.

Muitas pessoas transexuais acabam por se rejeitarem, tal é a estigmatização e discriminação existentes na sociedade. E o resultado é a auto-estima descambar.

Ficam pessoas que têm vergonha de serem quem são. E os psiquiatras aproveitam-se logo disto para fazerem vingar a sua teoria de que é o sexo que determina o género. Têm uma campanha que convence as pessoas que só é transexual quem se quer operar. Apanhando as pessoas com pouca ou nenhuma auto-estima, dizem frases que soam, para estas pessoas, como um engodo irresistível. Operas-te e ficas mulher (ou homem, conforme o caso).

Obviamente que estas pessoas já são mulheres e homens, pois é o que a sua IG lhes indica. E sabem-no perfeitamente, pois se não o fossem não eram transexuais. Mas a necessidade de elevar a auto-estima é muito forte, e acabam por, apesar de saberem bem demais que é a IG que determina o género, por interiorizar esta ideia e elevarem a auto-estima à custa de outras pessoas, que tem uma IG não concordante com o seu sexo, mas que até convivem o suficiente com esta situação para não desejarem passar por cirurgias introsivas e custosas em demasia.

E vai daí aparecerem classificações como “transexualidade primária”, “secundária”, etc, que felizmente se encontram a entrar em desuso, só utilizadas pelos mais reticentes às mudanças. O pior é que estas transexuais acabam por se convencerem que são melhores que as outras, que elas é que são mulheres.

Isto também deriva das pessoas transexuais (a partir daqui a serem denominadas como trans), devido ao modo displicente e muitas vezes ignorante como a sociedade vê estes assuntos, se convencerem que para serem mulheres ou homens têm de ter os atributos sexuais deles. Ou seja, sabem que são de um género, mas ao mesmo tempo têm dúvidas se o são efectivamente, pois não têm o sexo indicado.

E a IG, que lhes dá o mote para iniciarem processos, acaba por ser diminuída, sendo a genitália que comanda.

Isto tudo junto faz com que digam excentricidades como “nós é que somos, os outros/outras não passam de travestis”.

Tudo incica que é efectivamente a IG que determina o género de uma pessoa, não o sexo. Portanto quem é transexual é-o por ter uma IG de um género e o sexo de outro. A maioria das pessoas transexuais nem se quer operar. Mas como, para os psiquiatras, só as operadas contam, os outros casos são ignorados ou definidos como não transexuais.

PARTE III

Este estado de coisas contribui para que se encontrem espalhadas pela net, verdadeiras pérolas da lógica.

Por exemplo, num dado espaço de discussão algures nas profundezas da vastidão virtual, encontrei estas duas afirmações feitas pela mesma pessoa, uma transexual feminina:

Eu sou uma mulher, em todos os sentidos, incluindo a genitália.
Por qualquer razão, na presente realidade isso não se verifica, fisicamente falando. Por essa razão, estou a iniciar a transição, porque sou mulher com um corpo masculino.


Ok, tudo bem, nada a objectar: a seguir sai-se com esta “pérola”:

A transexualidade parece-me a mim algo de mais extremo. Homem e Mulher. Não se fica pelo intermédio.
O homem não tem vagina, a mulher não tem pénis.
Por isso é que nós, transexuais (e falo por TOD@S @s que conheço), desejamos para além do tratamento hormonal e do reconhecimento legal e social (como tu, XXXXX, referiste), a SRS, porque o nosso órgão genital simplesmente não nos pertence.


Primeiro afirma que é transexual, e pelas palavras vê-se que não é operada, portanto só se pode estar a referir à sua IG. De seguida afirma que homens não têm vagina e mulheres não têm pénis.

Se fosse assim, meramente a genitália a definir o nosso género, não havia transexuais. Se fosse assim, essa pessoa nunca poderia afirmar que é mulher, pois as mulheres não têm pénis.

Este pensamento, que originou inclusivé muitos tratamentos com electrochoques e outros que tais, e que ficaram para a história como tratamentos feitos à comunidade homossexual, é tão absurdo que qualquer pessoa trans, que sabe perfeitamente que muito antes de qualquer cirurgia já era homem ou mulher, vê logo a sua absurdidade.
Claro que, aqueles que já têm a cabeça feita, acham que só são homens e mulheres depois da cirurgia, o que convém muito a certos psiquiatras e psicólogos.

Como se viu, isto leva a declarações como a anterior, em que assume falar pelos trans, rectificando depois que afinal são só os que conhece, desejam fazer a CRS.
Claro que esta pessoa deve conhecer muito pouca gente, e se calhar os conhecimentos são filtrados, tipo só é apresentada a quem pense assim ou coisa parecida. Portanto no seu pequeno mundo isto até pode ser verdade.

O que incomoda mais é a absoluta negação de outro ponto de vista diferente. Quem não se quer operar, não é, ponto.

Conheci muitos clínicos que pensam assim. Caramba, até sei de clínicos que acham que as pessoas trans são doentes e que se deviam parar as CRS. Em Portugal, neste século.

Eu conheço, assim de repente, pelo menos, uma, duas, três, quatro, cinco, seis pessoas que são mulheres trans e não se querem operar.

Também, e então a nível da psique humana nem se fala, não existe nada extremo. Existem dois pólos opostos, e entre eles existe toda uma gama de graduações que suporta toda e qualquer pessoa existente, que tenha existido ou que venha a existir. Como com tanta coisa na vida, nada é extremo. Falar-se em situações extremas é completamente absurdo.

Mas as coisas virtuais não se ficam por aqui. Chegam ao ponto de se verem afirmações de Kenneth Zucker, o internacionalmente conhecido “especialista” em terapias de reparação do género em crianças e adolescentes, que visam a aceitação por parte da criança ou adolescente trans do seu género biológico. Não se sabe quantificar o mal que o dito especialista já fez a quantas crianças, mas seria agradável que quem com tanto afinco o cita (para tentar impingir a CRS obrigatória a pessoas trans) fosse para o Canadá e fizesse por lá o seu processo. Juntavam-se os transfóbicos e toda a gente ficava contente.

Outras “pérolas” existem como esta:

"A maioria dos transexuais, estudam, trabalham e têm uma vida normal e muito feliz DEPOIS da transição."

Falta aqui que estes trans são os que, depois da transição, abandonam tudo o que tenha a ver com transexualidade, e escondem o facto de o serem. E isto é importante. Importante porque a luta das pessoas transexuais é, ou pelo menos devia sê-lo, por uma vida estudantil e laboral “normal” (não se explica o que é considerado normal ou não) e muito feliz ANTES e DURANTE a transição, não só depois. Que toda a gente pode ter uma vida normal e feliz toda a gente sabe, Tem é de se lutar pelas condições necessárias.

Também seria interessante que se fornecesse os estudos onde se basearam para chegarem a esta conclusão, para fundamentá-la. Mas quanto a isso, nada.

Outra verdadeira “pérola” virtual esta:

por precisarem de viver a vida em prostituição dizem-se transexuais e mais uma vez, leva o nosso nome a sarjeta!

Algumas considerações: Em todos os compêndios que li, nunca vi escrito que quem seja transexual, tenha sido posto no olho da rua pelos pais, com uma mão à frente e uma atrás, e tenha tido a necessidade de recorrer à prostituição, não possa ser transexual por esse facto.

A realidade demonstra cabalmente que muitas pessoas transexuais têm de recorrer a esse meio de sobrevivência. As razões são muitas, mas baseiam-se quase todas em dois factores quase semelhantes: a discriminação e o preconceito.

Então temos umas quantas pessoas, que não foram postas fora de casa, que tiveram o apoio dos pais ou pelo menos o sustento, todas ofendidas, coitadas, porque existem outras que não tiveram tanta sorte.

E que pensar então de Carla Antonelli, que em dado momento da sua vida teve de vivenciar o trabalho sexual. Se calhar a Carla não é transexual porque foi trabalhadora sexual, querem ver... Ou se calhar a Carla dá mau nome às pessoas transexuais... Ou então a ignorância é tal que nem sabem quem é a Carla Antonelli.

O que eu penso desta atitude não fica bem aqui, ficava melhor noutro lado. Só digo isto: nunca fui nem fiz trabalho sexual, mas como mulher transexual repugna-me este tipo de atitudes, um reflexo da sociedade podre em que se vive hoje em dia, que ostraciza quem não vive sob uma moral católica.

Onde estava essa moral quando o Papa Pio XII, junto com a Cruz Vermelha internacional, ajudou criminosos nazis a fugirem para a América do Sul, como Adolf Eichmann, conhecido como o arquitecto do holocausto, ou Josef Mengela, o anjo da morte de Auschwitz-Birkenau? Esta moral afinal serve para quê? Para que trans ostracizem e discriminem outras trans? Faço ardentes votos para que esta gentalha acabe os seus processos depressa e desapareçam, senão da face da terra, pelo menos de Portugal.

Sempre fui contra a associação entre transsexualidade e trabalho sexual. Mas nunca, nunca discriminando quem teve de recorrer a este meio para sobreviver. Mesmo quem o faça por outras razões, não se pode aceitar esta discriminação, ainda por cima vinda de quem também sofreu e sofre com discriminações. Tenho vergonha que estas pessoas sejam transexuais, disto tenho vergonha, sim.

As restantes pérolas encontradas andam sempre à volta do mesmo (e existem muitas mais, estas são só as mais gritantes):

A definição mais acertada será “pessoa que nasce com a sua IG de um género e a genitália do género oposto. Note-se que mesmo a mais recente proposta do DSM já não submete a transexualidade à CRS, como estas pessoas ainda tendem a fazer.

O próprio Prof. Dr. Rui Xavier, na sua entrevista, mudou radicalmente o seu discurso e, muito embora ainda fale em transexualidade primária, já admite a existência de pessoas transexuais que não desejam fazer a CRS.

A nível mundial, a quantidade de pessoas que desejam fazer a CRS é largamente ultrapassada pelas que não o desejam. Não existem razões para duvidar que em Portugal o panorama seja diferente.

E não há razão nenhuma que justifique que o colectivo trans se submeta a uma tirania perpretada por uma minoria com o conluio dos psiquiatras e psicólogos.

O ser humano é mesmo assim, quando não há nada para discriminar, ostracizar e ofender, inventam.

One hundred and twenty-five Islamic boarding schools or pesantren from Java and Madura island issued a fatwa banning transvestites from cutting and/or styling Muslim women's hair unless they are muhrim (related by blood or marriage).

Re: "Phase-out of sex-change funding a 'reactionary move': researcher; Alberta Health and Wellness plans end of program by 2014-15," The Journal, April 28.
Some of the comments made by John Tuckwell, spokesperson for Alberta Health and Wellness, are concerning.
Tuckwell says that other provinces do not provide transgender surgical programs. This is incorrect. Ontario and Quebec both fund sex reassignment surgery (SRS). Ontario was forced to re-establish funding after it lost a class-action suit.
British Columbia provides funding for male to female SRS, and Saskatchewan and Manitoba provide funding for SRS, with the restriction that candidates must be assessed by the gender clinic in Toronto. The Maritime provinces provide funding on a case-by case basis, as does the Northwest Territories.
